- A Civilized Solution

 

Individuals seeking resolution in family law matters through the Courts are required to attend multiple management conferences in an effort to resolve their differences which may be time consuming, expensive, non-binding and contentious.

 

 

When couples separate and embark on divorce proceedings, you want to avoid a battle and have civilized negotiations that keep divorce out of the courts. While conventional divorce entails litigious exchanges between opposing lawyers for each partner, collaborative practice centres on bringing together the couple and their lawyers in settlement meetings.

 

The purpose of the meetings are to acquire resolutions to divorce matters including custody, financial support and the division of assets, reduce conflict and prevent going to court.  It is a reasonable, less antagonistic method to dissolving your marriage. 

 

Parties who choose to resolve the issues and differences related to their divorce through collaborative law or mediation are able to contribute to and define the terms of their separation agreement.   

 

Third party professionals, including child psychologists, financial planners and parent coordinators, may be included if both parties agree to additional expertise in complicated matters.  

 

If either party withdraws from the collaborative law negotiations the lawyers will not continue to represent them in future matters.
